The Compliance Counsel advises senior business leaders in compliance of various laws and regulations applicable to the Performant operations business divisions providing insight to upcoming changes in legal landscape, researching specific laws and regulations to determine impact on the business, collaborate with applicable business leaders to support development and maintenance of programs in support of compliance with laws and regulations, support review of contracts as may be applicable, conduct research and develop responses to account holder suits and support other internal or external resources and counsel in litigating and responding to legal matters.  This position will collaborate with business leaders, and other internal and external legal resources to perform a variety of legal compliance functions in support of recovery, servicing and healthcare operations.

Duties and Essential Job Functions:

Compliance Legal Functions

-Learns Performant business, services, contracts and all applicable laws, regulations & statutes in order to effectively perform function.

-Research, interpret and analyze business impact of existing, changing and new laws and regulations in support of a variety of business initiatives across business lines.

-Stay abreast of industry changes applicable to legal and regulatory compliance.

-Advise leadership on findings and recommendations.

-Collaborate effectively with business leaders in support of new development and continuous improvement of compliance processes, tools and functions for existing, changing and new lines of business.

-Support legal review of RFPs, RFIs, contracts, and other business documents.

-Researches and supports legal response to legal claims from borrowers/account holders.

-Collaborates with other internal/external counsel, clients, legal and compliance resources in support of any civil litigation arising from account servicing activities.

-Perform assignments and scope of responsibilities at all times demonstrating the Company core values and in the best interest of the Company.

-Develop tools and methodologies applicable for the function.

-Complies with all company policies and procedures, completes all assigned compliance and other training within required dates, and applies learning effectively.

-Maintains confidentiality

Relationships and Collaboration

-Build collaborative relationships and communicate effectively with internal cross functional leadership and subject matter experts, as well as applicable external legal counsel, resources, clients, vendors and partners as may be applicable.

-Foster teamwork and collaborate internally with cross-functional teams.

Team Management

-Effectively plans, manages and controls activities of legal review activities and resources as may be applicable to scope of responsibility to achieve maximize results.

-Ensure appropriate skills and resources to meet business needs, in a manner that is in the best interest of the company.

-Serves as positive role model and leads by example in alignment with company mission, vision and values.

Required Skills and Knowledge:

To perform this job successfully, an individual must be able to perform each essential function satisfactorily. Below are representative of the knowledge, skills, and abilities required.

- Knowledge of general contract law with expertise in government contracts – state and federal

-Knowledge or ability to become familiar with state legislation and authorities (regulations, executive orders, etc.) affecting Performant business interests across all business lines.

-Strong business acumen coupled with critical thinking abilities; Sufficient knowledge of business to understand Performant’s lines of business, revenue and earnings, risks and impacts

-Ability to participate in a team process in review and assessment of requirements and risks associated with various government (federal and state) and private sector business opportunities as expressed in RFP’s and formal and informal solicitations.

- Knowledge or ability to become familiar with of federal lobbying process and rules.  Ability to participate as a team member in development of statutory language needed in lobbying process.

-Knowledge of civil litigation processes in various states in which Performant has business locations and interests.

-Strong influencing, facilitation, and interpersonal communication skills one-on-one and in group settings.

-Possess ability to lead in a team environment where collaboration to solve problems, generate solutions and the knowledge transfer process are critical for success.

-Ability to build and maintain strong relationships both internal and external to the organization and with all levels of audience from individual contributor to executive.

-Ability to deal well with ambiguity.  Can effectively shift gears comfortably, can decide and act without having the total picture, comfortable handling risk and adversity.

-Some travel required.

Physical Requirements Performs essential functions of the job in an office setting. 


-Lift/carry/push/pull under and over 10lbs occasionally

-Keying frequency, handling, reaching, fine manipulation

Education and Experience:

-Minimum of 3 years of relevant legal experience preferably in federal and state contracting areas

-Experience in collections/recovery industry or healthcare audit and recovery highly desired

-Demonstrated experience directly or indirectly leading and developing staff and teams

-Juris Doctor (JD) Licensed to practice law in at least one state with evidence of good standing, preferably CA.

Other Requirements     
-Must submit to and pass background check.
-Must not have any Federal or State liens resulting from County, State or Federal tax issues. 
-Must not have any current defaulted student loans.
-Must be able to pass a criminal background check; must not have any felony convictions or specific misdemeanors.
-Must submit to and pass drug screen.

Performant is a government contractor. Certain client assignments for this position may require submission to and successful outcome of additional background and/or clearances throughout employment with the Company.
